Dividing military retirement is not the same as dividing a 401(k). Different order, different agency, different deadlines, and one of them expires a year after your divorce.

Most people call this a military QDRO. It is worth knowing early that it is not one.

A QDRO divides a private employer plan under ERISA. Military retired pay is divided by a different order entirely, under a federal law called the USFSPA, and it goes to DFAS rather than to a plan administrator. DFAS will reject an order that does not meet its requirements, and a rejection costs months.

A military divorce usually needs three orders, not one

This is where most of the damage happens. Retired pay, the Thrift Savings Plan, and Survivor Benefit Plan coverage are three different things handled three different ways.

A decree that addresses only the pension leaves two assets undivided and one deadline running.

The deadline nobody mentions

Military retired pay stops when the service member dies. If you were awarded half the pension and there is no Survivor Benefit Plan coverage in place, that income can end with them.

SBP coverage for a former spouse has to be elected. A former spouse can file what is called a deemed election directly with DFAS, and that window is one year from the date of your divorce.

It does not matter what the decree says if the election is never filed. This is the single most expensive thing we see missed, and it is missed quietly, because nothing about it appears on a statement. If your divorce was recent, this is the first thing to check.

The 10/10 rule does not mean what most people think

You will hear that you need ten years of marriage overlapping ten years of service to get any share of a military pension. That is not what the rule does.

The 10/10 rule governs who writes the check. Meet it, and DFAS pays the former spouse directly. Fall short, and a court can still award a share; it just has to come from the member instead. The real difference is collection, not entitlement. People give up real money believing otherwise.

Two things that quietly change the number

If the member is still serving, the divisible amount is likely frozen.For divorces after the 2017 rule change, the calculation is generally based on the member's rank and years of service at the time of divorce, not at retirement. Older worksheets still circulate using the pre-2017 formula, and they produce a number that will not hold.

VA disability can reduce the share after the fact. Only disposable retired pay is divisible. If a retiree later waives retired pay to receive VA disability compensation, disposable pay falls and the former spouse's share falls with it. The Supreme Court has held that a state court cannot order the retiree to make up the difference. That exposure can be modelled before you sign. It usually is not.

If you are in the Reserve or Guard

Reserve and National Guard retirement is calculated on retirement points rather than years of active service, and payments generally begin at age 60. A formula written for active duty will not divide it correctly.

Is a military pension divided with a QDRO?
No. A QDRO divides a private employer plan under ERISA. Military retired pay is divided by a court order under the USFSPA and submitted to DFAS. The term “military QDRO” is common, but the instrument is different.
Do I lose my share if we were married less than ten years?
Not necessarily. The 10/10 rule determines whether DFAS pays you directly, not whether you are entitled to a share. A shorter marriage can still be awarded one, paid by the member.
What happens to the pension if my former spouse dies?
Retired pay stops. Survivor Benefit Plan coverage is what continues a portion to you, and it has to be elected. A former spouse generally has one year from the divorce to file a deemed election with DFAS.
Can VA disability reduce what I receive?
Yes. Only disposable retired pay is divisible, and a waiver of retired pay in favour of VA disability reduces it. Courts cannot order the retiree to make up the difference, so this is worth modelling before you settle.
Is the Thrift Savings Plan included?
The TSP is a separate asset requiring its own order. It matters more for members under the Blended Retirement System, where the pension multiplier is smaller and the TSP is a larger share of the retirement benefit.
